1. About qwertips

qwertips is a web-based platform that provides digital tools for hospitality and beauty businesses, including QR-based menus, guest interaction features, and voluntary tipping flows.

qwertips does not act as a payment service provider and does not process, store, or control funds or payment card data.

2. Eligibility

You must be at least 18 years old to use the Service.

If you use the Service on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms.

3. Types of Users

Depending on how you interact with the Service, you may act as one of the following:

Guests – individuals who access the Service via QR codes, use the Digital Menu, and may leave voluntary tips.

Staff Members – individuals who receive tips through the Service.

Merchants – businesses and their authorized representatives using the Service to manage venues, menus, and related features.

Different features may apply to different user types.

4. Voluntary Tips

All tips made through qwertips are voluntary.

qwertips does not guarantee that tips will be successfully received by staff members and is not responsible for payment authorization, settlement, or payout.

Payment processing and payouts are handled entirely by licensed third-party payment service providers.

5. Payments and KYC

qwertips does not collect or store payment card details.

Identity verification (KYC) for staff members receiving tips is conducted by approved third-party providers and is a mandatory requirement to receive payouts.

qwertips may store only verification status and reference identifiers for compliance purposes.

6. Merchant Responsibilities

Merchants are responsible for ensuring the accuracy of venue, menu, and content information, complying with applicable laws and regulations, ensuring that staff members are eligible to receive tips, and informing their staff about applicable terms and processes.

7. User Conduct

Users must not misuse or interfere with the Service, attempt unauthorized access to systems or data, use the Service for unlawful or fraudulent purposes, or upload or share content that is illegal, misleading, or infringing on third-party rights.

qwertips may suspend or restrict access to the Service if these Terms are violated.

8. Intellectual Property

All intellectual property rights related to the Service, including software, branding, and design, belong to qwertips or its licensors.

Users are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.

9. Availability and Changes

qwertips may modify, update, suspend, or discontinue parts of the Service at any time.

We do not guarantee uninterrupted or error-free availability of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, qwertips shall not be liable for payment failures or delays caused by third-party payment providers, loss of tips due to technical or external factors, or indirect, incidental, or consequential damages.

Nothing in these Terms limits liability where such limitation is prohibited by law.

11. Indemnification

You agree to indemnify and hold harmless qwertips from claims, damages, losses, and expenses arising from your misuse of the Service or violation of these Terms.

12. Termination

qwertips may suspend or terminate access to the Service if you violate these Terms or if required by law.

Termination does not affect rights or obligations accrued prior to termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Poland, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be published on our website with a revised “Last updated” date.
